Congresswoman Tenney Introduces Legislation to Stop China from Evading U.S. Trade Laws

Washington, DC – Congresswoman Claudia Tenney (NY-24) today introduced the bipartisan and bicameral Fighting Trade Cheats Act to combat malign foreign actors, like China, from evading U.S. trade laws and dumping foreign-made goods into U.S. markets. It will also protect good-paying jobs for American workers.

Rep. Mike Bost (R-IL) and Rep. Terri Sewell (D-AL) led the House version of the bill, while the Senate version was introduced by Senators Sherrod Brown (D-OH) and Thom Tillis (R-NC)

The U.S. Customs and Border Protection (CBP) has limited resources to respond promptly to foreign entities working to bypass U.S. antidumping and countervailing duties (AD/CVD), who then flood our markets with cheap foreign goods as well as sending goods to third-party countries to skirt U.S. trade protections.

Specifically, this bill works to stop foreign nations from abusing U.S. trade laws by tripling penalties for offenders and denying the importer the proper credentials. In addition, this would allow U.S. companies to sue foreign producers directly for causing harm to U.S. markets.

“Our adversaries, like China, have consistently violated U.S. trade laws, hurting Upstate New York businesses and workers,” said Congresswoman Tenney.“Now more than ever, we must enact policies that will give our country the right tools to strongly enforce our trade laws and protect our economy. The Fighting Trade Cheats Act responds to this and ensures that no foreign entity is above the law while increasing penalties for malicious actors.”
